Terms of Service

Draper Mock Oral Platform — Last Updated: March 28, 2026

These Terms of Service ("Terms") govern your access to and use of the Draper Mock Oral Platform ("Platform," "Service," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

"Institution" means the medical residency program, fellowship, or medical education organization that holds a license to use the Platform.

"Administrator" means an individual authorized by the Institution to manage the Platform on behalf of the Institution.

"User" means any individual who accesses the Platform, including Administrators, Examiners, and Examinees.

"Content" means all materials uploaded to or generated by the Platform, including but not limited to examination scenarios, question stems, clinical images, scores, and resident data.

2. Account and Access

2.1. Access to the Platform is provided through institutional licenses. Each Institution receives an isolated environment with its own data, content, and user accounts.

2.2. Administrators are responsible for managing user accounts, credentials, and access within their Institution's environment.

2.3. Login credentials are confidential. Examiner credentials expire the day after the scheduled exam date. Examinee credentials are single-use and are consumed upon first login.

2.4. You must not share, transfer, or disclose your login credentials to unauthorized individuals.

3. Permitted Use

3.1. The Platform is intended solely for the administration of mock oral board examinations within medical education programs.

3.2. You may use the Platform to: create and manage examinations; upload, store, and distribute examination content; generate and distribute credentials; score examinees; and track question history.

3.3. You may not use the Platform for any purpose other than its intended educational purpose, or in any manner that violates applicable law or regulation.

4. Institutional Content

4.1. All Content uploaded by an Institution remains the property of that Institution. We do not claim ownership of Institution Content.

4.2. Content is stored in an isolated environment and is not accessible by other Institutions or by us, except as necessary to provide the Service or as required by law.

4.3. Institutions are solely responsible for ensuring that their Content does not infringe on any third-party intellectual property rights.

4.4. Upon termination of a license, we will provide the Institution with a reasonable period to export their Content before deletion.

5. Data Privacy and Security

5.1. We implement industry-standard security measures to protect User data, including encryption of credentials at rest (AES-256-GCM), secure session management, and role-based access controls.

5.2. Resident performance data, scores, and personally identifiable information are stored within the Institution's isolated environment and are not shared across institutions.

5.3. We do not sell, rent, or distribute User data or Content to third parties.

5.4. Institutions are responsible for complying with their own institutional policies regarding the handling of trainee performance data.

6. License Tiers and Fees

6.1. The Platform is offered under annual license agreements with tiered pricing based on program size and feature requirements.

6.2. License fees are billed annually in advance. Specific pricing is as agreed upon in the executed license agreement between the Institution and Draper Mock Oral.

6.3. License limits (number of residents, exams, administrators) are enforced by the Platform. Exceeding license limits requires an upgrade to a higher tier.

6.4. Trial licenses are provided at no cost for a limited period and with limited capacity, as specified at the time of provisioning.

7. Availability and Support

7.1. We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

7.2. Support is provided via email. Enterprise license holders receive priority support as specified in their license agreement.

7.3. We are not responsible for disruptions caused by factors outside our reasonable control, including but not limited to internet outages, third-party service failures, or force majeure events.

8. Limitation of Liability

8.1. The Platform is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2. The Platform is an educational tool for mock examination preparation. It is not a substitute for official board certification processes, and performance on the Platform does not guarantee performance on actual board examinations.

8.3. In no event shall Draper Mock Oral be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform.

8.4. Our total liability for any claim arising from or related to the Platform shall not exceed the amount paid by the Institution in license fees during the twelve (12) months preceding the claim.

9. Termination

9.1. Either party may terminate the license agreement with thirty (30) days written notice.

9.2. We may suspend or terminate access immediately if an Institution or User violates these Terms.

9.3. Upon termination, the Institution will have thirty (30) days to export their Content. After this period, Content may be permanently deleted.

10. Modifications

10.1. We may update these Terms from time to time. Material changes will be communicated to Administrators via email or in-platform notification at least thirty (30) days before taking effect.

10.2. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pitt County, North Carolina.
